This raises many questions about how the process can take place when the property is not vacant or easily accessible for open homes, agent appraisals, valuations, renovations, and so on. How do agents get access to a property that is someone else’s home? How do tradies carry out work while the property is being lived in? What rights do the tenants and owners have about granting or withholding access to the property?As agents we strive to respect everyone’s rights. After all, if the property is sold to an investor, in most instances a new landlord would welcome an existing tenancy carrying on rather than going to the expense of finding a new tenant. Good relations are important to almost every agent I know, whether they are dealing with a tenant (who may one day become a buyer then a seller!) or a buyer or seller. The legislation requires we seek written permission from the tenant. The rights between tenants and landlords are carefully weighted under the current legislation and while it’s a popular opinion that tenants have few rights, in reality that’s not the case. For example, landlords cannot arrange entry on a Sunday or a public holiday. They cannot arrange entry before 8am or after 6pm, unless the tenant agrees to it. Under the Residential Tenancies and Rooming Accommodation Act (2008) if a landlord wants to terminate a fixed tenancy agreement, the landlord must inform the tenants 60 days before the lease termination date that the lease will not be renewed.If you are an investor and you’re thinking about selling your tenanted property it’s important to start planning early and to appoint an agent who has experience in this area. Often, the job will be made much easier if you wait until the tenancy has expired. Selling a vacant property is much more simple.
